These terms govern your use of NounDesk — a service for creating and displaying website notifications, banners, and popups. By creating an account or using the service, you agree to these terms.
The service
NounDesk provides a dashboard for creating campaigns and an embeddable JavaScript widget that displays them on your website. You are responsible for installing the widget on sites you own or are authorized to manage.
Free beta
NounDesk is currently free while in beta. Paid plans will be introduced later; when they are, we'll give existing users clear advance notice before anything becomes chargeable. Nothing you do today creates a payment obligation.
Your account
- You must provide accurate information and keep your login credentials secure.
- You are responsible for activity that happens under your account.
- One person or organization per account; team members can be invited where supported.
Acceptable use
You agree not to use NounDesk to:
- Display unlawful, deceptive, defamatory, or malicious content, including phishing or malware.
- Impersonate another person or organization, or misrepresent who a notification is from.
- Install the widget on websites you do not own or have permission to manage.
- Circumvent visitor consent requirements that apply to your audience (e.g., GDPR).
- Probe, overload, disrupt, or attempt to gain unauthorized access to the service.
We may suspend or terminate accounts that violate these rules, with notice where practical.
Your content
You retain ownership of the content you create in NounDesk. You grant us the limited license needed to store, process, and deliver that content to your websites — that's it. You are responsible for ensuring your campaigns comply with the laws that apply to you and your visitors.
Service availability
We work hard to keep NounDesk fast and available, but during beta we do not offer an uptime guarantee or SLA. We may change, pause, or discontinue features as the product evolves.
Disclaimer of warranty
The service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
Limitation of liability
To the maximum extent permitted by law, NounDesk will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from your use of the service. During the free beta, our total aggregate liability is limited to $100.
Termination
You can stop using NounDesk and ask us to delete your account at any time. We may suspend or terminate access for violations of these terms or to protect the service and its users.
Changes to these terms
We may update these terms as the product evolves. If we make material changes, we'll update the date above and notify account holders by email. Continued use after changes take effect means you accept the updated terms.
